Terms and Conditions (T&C) for "Hunting & Gathering"

1. Scope
   These Terms and Conditions (T&C) apply to the use of the mobile application "Hunting & Gathering" (hereinafter referred to as "App") on the iOS and Android operating systems, which is offered through the Apple App Store and Google Play Store. The app is operated by Hauke Olf (hereinafter referred to as "Provider").

2. Scope of Services
   The app allows users to track and analyze activity data (steps & distance). The stored data can be used for personal activity tracking. The use of the app requires registration via third-party authentication services (e.g., Google or Apple).

3. Terms of Use
   (1) The use of the app is free of charge but includes optional paid features.
   (2) Users must be at least 16 years old or have the consent of a legal guardian.
   (3) It is prohibited to misuse the app, especially by manipulating step count data.

4. Data Protection
   (1) The app processes personal data in accordance with applicable data protection regulations (see Privacy Policy).
   (2) Collected step and movement data are stored exclusively on the device or in Firebase Cloud.
   (3) Data will not be shared with third parties without the explicit consent of the user.

5. Disclaimer of Liability
   (1) The provider does not guarantee the accuracy or completeness of the collected data.
   (2) The provider is not liable for health, technical, or other damages arising from the use of the app unless caused by intent or gross negligence.
   (3) The provider is not liable for data loss caused by technical errors or force majeure.

6. Availability and Changes to the App
   (1) The provider strives for high availability of the app but cannot guarantee continuous and error-free operation.
   (2) The provider reserves the right to update, modify, or discontinue the app at any time.

7. Contract Duration and Termination
   (1) The use of the app is for an indefinite period.
   (2) Users can terminate use at any time by uninstalling the app.
   (3) The provider may terminate or restrict a user’s access to the app at any time without stating reasons, particularly in the event of violations of these T&C.

8. Final Provisions
   (1) The law of the Federal Republic of Germany applies unless mandatory legal provisions dictate otherwise.
   (2) Should any provision of these T&C be or become invalid, the validity of the remaining provisions remains unaffected.
   (3) The provider reserves the right to amend these T&C at any time. Users will be informed of significant changes.
